All of Advance Carts are covered by a one-year limited warranty to the buyer against defects in material or workmanship only. The one-year limited warranty is established the date that you receive your item(s). ADVANCE CARTS does not warrant any item(s) that have been modified or that may have sustained damage due to the usage of a motorized cart pusher or puller. ADVANCE CARTS makes no other express or implied warranties, including, without limitation, implied warranties of merchantability or fitness for a particular purpose.
To report a warranty claim…
- Contact ADVANCE CARTS Customer Service Department via toll-free telephone at (877-575-0469) or via e-mail at email@example.com and request claim form.
- Complete the claim form and return it Advance Carts, INC. (Photographs of the claimed defect(s) must be included with the claim).
- Once your claim has been processed and approved, Advance Carts, INC. will send the appropriate repair/replacement parts (including service labor to replace defective components) and/or replacement carts to cover the claim.
- Advance Carts, INC. may not accept responsibility of a claimed defect due to abuse, improper maintenance, misuse, neglect and/or the item(s) in question are beyond then one year limited warranty period. In such event, Advance Carts, INC. will be more than happy to supply repair/replacement parts required to repair the item(s) at prevailing prices.
Under no circumstance shall ADVANCE CARTS be responsible for nonperformance caused in whole or in part by circumstances beyond the control of ADVANCE CARTS, including, but not limited to, fires, floods, acts of God, war, or public enemy, embargoes, riots, civil commotion, or sabotage, epidemics or quarantine restrictions, strikes, differences with employees, casualties, delays in transportation, inability to obtain necessary materials, utility services energy, transportation, labor or machinery, total or partial shutdown of ADVANCE CARTS’S operations for any cause, action or inaction of any governmental authority. If ADVANCE CARTS is unable to supply the total demand for the Product, then ADVANCE CARTS may distribute its available supply among any or all purchasers as ADVANCE CARTS may deem fair and practical, without liability for any failure of performance which may result therefrom.
ADVANCE CARTS and Buyer agree that this Agreement shall be governed by and construed in accordance with the substantive laws of the Commonwealth of Virginia, without regard to the conflicts of law provisions thereof. Buyer hereby consents to the jurisdiction of the federal and state courts in the Commonwealth of Virginia for the resolution of all disputes, and hereby waives any objection to venue.This Agreement supersedes any prior agreements. This Agreement is not assignable or transferable by Buyer, in whole or in part. ADVANCE CARTS reserves the right to sell, assign, or otherwise transfer its right to payment under this Agreement. No modification of this Agreement shall be binding on ADVANCE CARTS unless such modification is in writing and signed by both ADVANCE CARTS and Buyer. Unless Buyer shall notify ADVANCE CARTS in writing to the contrary as soon as practicable after Buyer’s receipt of this Agreement, Buyer’s acceptance of the products or payment thereof shall be equivalent to Buyer’s assent to the Agreement. ADVANCE CARTS’S waiver of any default by Buyer hereunder shall not be deemed a waiver by ADVANCE CARTS of any other default by Buyer.
